    A case that has been hanging over the heads of homeless people in Victoria for almost 2 years has been postponed by the Attorney General of British Columbia. One of the Lawyers working probono on behalf of the homeless updates the situation.

    “Everything was filed on time to get the 18a set for September 10, 2007 and the Province and Canada were served with the notice of constitutional question in accordance with the legislation.” said Irene Faulkner.

    The Attorney General's office has asked to postpone the case, likely until February 2008.

    The city of Victoria has more than 1,200 homeless people and only 170 bed, therefore, a law that criminalizes sleeping outside is unconstitutional.

    A handful of homeless people are kicking butt in Victoria's supreme withthe city own laws. This is a small victory that will have a major impact on the entire country. The group is ready to go to court on Sept 10 at 9:30am at the Burdett St courthouse. When you get to the public hearing if you do come just look up the court room under the city of Victoria. We the homeless don't deserve the right to have our names place of the court dociments when we are winning. But the city does even though it looks like they are not winning.     It's been a long road but the homeless may get their day in court on September 5, 2007. The orginal dae was Sept4 and then it was posted until Sept 10 and final as of Friday Sept 1 it has been rescheduled for Sept 5 at 9:30am at the downtown courthouse (Burdette and Blanshard St)
