City of Victoria Violates Human Rights, Homeless Become Political Prisoners
2008.11.01 - 3:34 PM
The City of Victoria was ordered by the BC Supreme Court to strike down by-laws that prohibited erecting temporary structures.
Despite the judges ruling that these by-laws were unconstitutional and violated homeless people's right to life, liberty and security of person, the city insists on enforcing these by-laws.

Interesting to watch the liars squirm, as I am an orphan I am beyond being hyper vigilant, and as such I can read the officers thoughts faster than he can try and hide them with his facial movements, thank creator for the gift of sight, the cops will learn the hard way. Judges hate liars.
From Lise - don't know why it says Rose
The young woman is spot on. The judge left it open. Homeless people have a right to protect themselves, finally, from the elements - at least better than before. But madam justice Ross was limited in what she was allowed to order. She struck down the tenting in parks bylaw, but that does not mean the city was without the (misguided) right to add a bylaw qualifying that. Making it 9:00 pm (after dark and hard to set up tents) to 7:00 a.m. (when most people are not using parks) is mean, and following the letter rather than the spirit of the ruling. It certainly doesn't take into account those who are sick, dying or disabled. Or that a person's right to survive should quite obviously take priority over someone's right to a stroll in the park without witnessing people in obvious distress with nowhere else to go. Even though this new addition obviously had its basis in fear rather than reason, it is legal. The judge did not have control over that part of it. The cop in the video here is not lying and he is doing as he is told. He is an employee of the city. He is 'just doing his job' and is a person too. Yes, I have witnessed police abuse too but lets acknowledge this particular cop's decency and patience. Us and Them in my books deletes communication. Our society is more complicated than that. Everyone counts -or should.
What needs to happen is that an agreement be reached with the city that satisfies everyone. A designated tent city spot, as well as the right for some people to camp separately and quietly, is the most logical until people can be housed. At the rate that is going it could be many years more. Kind of reminds me of absentee dads who think that missing child support payments somehow won't affect the child's ability to eat or have shelter.
Part of the solution is the upcoming election on November 15th. As apathetic as some people may feel, this should not be overlooked or we will continue with the status quo - which is lousy.
Because of their appeal, it looks like we are at a stalemate with this council and will have to wait until a new council is elected - by all of us. Those of us with homes and thus more time on our hands can work for candidates in this election who have proven they are compassionate people who walk the talk in making this world a better place for those most disadvantaged in our society. Get to know your candidates; determine for yourselves. And then we can ALL vote in these people with a more mature view of municipal financial management. (Those of you who don't have ID can still get it through Carole Jame's NDP office on Fort Street.)
I am a fiscal conservative. I say responsible individuals and politicians responsible for their city must prioritize the human right to survival over entertainment, renovations and 'things' always.

Take the risk
Here in Montreal when the police give ticket over and over to the poor people just cause other people would like to have a clean touristic city. That not fare and also, it is when they found that your are on wealth-fare they give you even more. That not respecting human right!
We are many like this ... Myself I do my best to get healthy and I see many people who need valuable help to recover from bad addiction. But, Also many time I get ticket myself! Just as anyone engine out to long.
What about Ottawa? I would like to know what they think about it !
8-) best wich for hope faith and courage !
We need to create common ground.
Allow the depraved and homeless to utilize run down buildings long abandoned at their own risk and allow them the means to rehabilitate them into homes. When human life is wasted for the sake of the dollar and the guilty it's time to re-evaluate our priorities.
