On September 20, 2006 at approximately 10:20 am. I was rollerblading in the right of way for pedestrians such as joggers, horse carrages, cyclists, extra. A man about 6'4" dark blackish hair slightly greying about 46 to 48 years old , driving a black convertible Cadilac Eldarado, Licence Plate # KBR 472, tried to run me over three times and then stopped his car on the third attempt and tried to hit me with his door. I attempted to defend myself when I was attacked form behind by a man with short blonde hair about 220 lbs, 6"2" age 39 to 42. I am left with a permanent neck and back injury from this event. My question is who were these men. And shortly after about 10:30 am a man driving a black SUV , age approximately the same as the Attorney General of BC and a woman passed me by and stopped and looked at me while I was struggling in pain .

It looks like the Canadian Human Rights Commission can only help you with a complaint if you can answer yes to all of the following questions:
When the Commission receives an inquiry, an officer determines whether the matter is one the Commission can deal with. The officer considers the following questions:
Does the person have the right to file the complaint?
Has the complaint been filed within one year of the alleged events?
Does the employer, union or service provider fall under federal jurisdiction?
Is the situation described considered a discriminatory practice under the Canadian Human Rights Act?
Is the discrimination based on one of the 11 prohibited grounds listed in the Canadian Human Rights Act?
If the answer to any of these questions is “no,” then they can't help you. If the answer is yes, then they will send you an kit with an application form. I don't know if you've contacted them yet, but you need to contact them through either telephone, fax or mail to inquire about making a complaint. Here is there contact information:

I got this information from their website. I don't know anything about the human rights processes, so I couldn't help you in figuring out whether you fall in their jurisdiction.
Just by way of an update on your file here, if you remember, we made a service complaint about how they breached your privacy rights in January and as a result I've asked them to figure out a better way to provide you with service. I'm still waiting for the Ministry to explain to me their plan for providing you with service. They have agreed that they need a process for doing so, but they are taking a long time to figure it out. I've already called this week to remind them about this. I will keep calling them until they provide a plan and let you know once I hear something.

My RRSP is from Canadian Pacific Rail, my severnace was on February 10. 1996.
When I requested my RRSP be transfered from Bank Of Montreal to the Canadian Western Trust the Toronto Dominio-Canada Trust had place seizure on my RRSP and subsequnently the transfer to CWT was delayed and the Bank Of Montreal paid me a cash interest payment because ot this delay. Could you please explain why.

The Office of the Superintendent of Financial Institutions (OSFI) is responsible for the regulation and supervision of federally registered private pension plans. The applicable legislation with respect to a pension plan depends on the nature of the work, business or undertaking being performed. The Pension Benefits Standards Act (PBSA) applies to federal undertakings such as banking, airlines, telecommunications, interprovincial and international transportation. If you would like to provide us with the originating pension plan name, and registration number if available, we would be able to confirm that your RRSP funds are indeed administered under the federal PBSA.
Under the PBSA, a pension benefit cannot be seized as long as it remains in a pension plan or in a locked-in vehicle such as a locked-in RRSP. However, in the case of a marriage breakdown, pension assets can be subject to applicable provincial property laws, and the PBSA permits the division of pension assets by court order or written agreement under these laws.
Without any more information, it is not clear at this time how OSFI may be of further assistance. If you would like to write to us again with your specific questions, we would be happy to look into your request at that time.

I have a locked in federal pension plan located in trust with Canadian Western Bamk, through the Victoria branch of Canadian Western Bank. I understand that the GIC is held in their trust company in Vancouver.
My concerns are as follows: when I transfered the RRSP from Bank of Montreal to The Candian Western Bank the Bank of Montreal told me that they could not release my RRSP to the Canadian Western Bank as apparently an unidentified third party from the Toronto Dominion Bamk had put a hold on my RRSP account.
I would like to know who the third party was and why, as the transfer was delayed for some time and following the transfer BMO gave me a cash interest payment because of the delay.
Currently, I believe the Ministry Of Human Resources and the Ministry of Employment and Income Assistance either are or were the third party. I want assurance that my RRSP is protected as per the Canadian Pension Benefits Act and as well under CDIC. I also want to know if currently there is a third party attempting to or who are placing an encumbrance on my GIC.

Thank you for your e-mail of September 26, 2007 about deposit insurance coverage provided by Canada Deposit Insurance Corporation (CDIC).
CDIC is a federal Crown corporation created in 1967 to insure eligible deposits at member financial institutions in case of their failure. CDIC’s members are banks, trust companies and loan companies and cooperative credit associations that have CDIC membership.
CDIC insures eligible deposits at each member institution up to a maximum of $100,000 (principal and interest combined) per depositor in each of the following categories:
(a) savings accounts, chequing accounts, and term deposits,
(b) deposits in trust for another person,
(c) joint deposits (except in the case of joint deposits, the maximum coverage applies to all eligible deposits in the names of the same joint account holders at the same institution),
(d) deposits in Registered Retirement Savings Plans (RRSPs),
(e) deposits in Registered Retirement Income Funds (RRIFs) and
(f) realty taxes on mortgaged property.
To be eligible for deposit insurance, deposits must be payable in Canada, in Canadian currency. Term deposits must be repayable no later than five years after the date of deposit.
For the purposes of calculating deposit insurance, eligible deposits within a locked-in RRSP would be combined with eligible deposits in RRSPs held by the same depositor up to the $100,000 limit.

Dear Mr. Tremblay,
If you have recently filed a human rights complaint the correct body that you would have sent the form to would have been the BC Human Rights Tribunal and NOT us, the BC Human Rights Coalition. As explained in my original email to you on September 25, 2007:

We, the BC Human Rights Coalition (BCHRC), are a separate organization from the BC Human Rights Tribunal (BCHRT). Our mandate is to provide community education around human rights issues related to employment, tenancy, and accommodation/public services as specifically outlined in the BC Human Rights Code; to assist person(s) wanting to file a human rights complaint with the BC Human Rights Tribunal (BCHRT); and providing representation to complainants whose complaints have been accepted by the BCHRT during the Tribunal process.
In sum, the BCHRT is the 'court' system where you file a human rights complaint and we, the BCHRC, are the 'legal aid' organization.
The purpose of filing a complaint is to negotiate compensation/remedies for the person who has been discriminated and/or sexually harassed against. Filing a human rights complaint is similar to 'suing' someone in court.

It doesn’t appear this is a letter sent to you from the Ministry but e-mail correspondence from Customer Service at the TD Bank. From the note, it appears that funds were not handled according to the Pension Benefits Standards Act, 1985. Our letter confirms that our plan is registered federally and funds were transferred under the the federal regulations. If the Bank of Montreal did not handle the funds under the proper legislations, then you would have to take up this issue with the financial institution. You can certainly use our letter to confirm jurisdiction.

I just came across this note and it appears you were able to open the attachment. I am not sure what other information you require. By stating the regulations that apply under the pension plan that advises other agencies how to handle any type of action under the regulations.
